Peer4Peer Terms of Service
Effective date: October 9, 2026
These Terms of Service ("Terms") form a legal agreement between you and Peer4Peer Lending, LLC ("we", "us"). By creating an account or using the Peer4Peer mobile application and related services (the "Service"), you agree to these Terms.
1. What Peer4Peer is
Peer4Peer is a friends-and-family / community micro-lending network. Peer4Peer Lending, LLC is not a bank, is not a lender, and does not itself provide credit. We operate a marketplace that lets individuals in the United States who know each other, or who choose to transact through our community, make small-dollar loans to one another. Interest is capped at your state's small-loan statutory maximum; states without a cap use 35% APR, and no loan ever exceeds 35% APR. Pennsylvania borrowers see the strictest cap at 6% APR (Pennsylvania Loan Interest and Protection Act, 41 P.S. § 201).
2. Eligibility
You must be at least 18 years old, a U.S. resident with a valid government-issued ID, and have a U.S. bank account and U.S. debit card. Peer4Peer currently serves all 50 U.S. states and the District of Columbia; the APR cap applied to your loans is driven by your state of residence.
3. Loan terms we enforce
- Loan amounts: $50–$500 (Basic tier), up to $5,000 (Plus tier).
- Repayment terms: 7–30 days (Basic), up to 60 days (Plus), or 5 weekly installments over 35 days.
- Lender return (interest): capped per borrower at their state's statutory small-loan APR limit (35% simple APR in states without a cap; never above 35%), pro-rated to the loan term. Pennsylvania borrowers see 6% APR.
- Platform service fee: 4.0% of the loan amount, paid by the borrower to Peer4Peer Lending, LLC at the end of the loan — it is added to the borrower's final repayment, and the borrower receives the full loan amount at funding. If a loan is not repaid, the fee remains owed. Lenders pay no platform fee. This is a marketplace facilitation fee, not interest, and is not included in the APR cap; where required by law (e.g. the federal Truth in Lending Act) it is disclosed as part of the finance charge.
Example: a $500, 30-day loan in a state with no small-loan cap: the borrower receives the full $500.00, repays $508.22 to the lender ($500 + $8.22 interest at 35% APR) plus the $20.00 platform fee with the final payment — $528.22 total. In Pennsylvania (6% APR): $500 + $2.47 interest + $20.00 fee = $522.47 total.
- Late fee: $5 flat per installment paid more than 24 hours after its due date. The late fee is paid to the platform (not the lender) and is intended to recover operational cost, not as interest.
- Early repayment: borrowers may repay in full at any time with no additional fee.
4. Your Account
- You are responsible for keeping your password confidential.
- Share your Peer ID freely; never share your password.
- You may be required to verify your identity under our Know-Your-Customer process.
- You may be locked out of your account for a short period after repeated failed sign-ins.
5. Borrowing
- You agree to repay each loan on the schedule you accept at funding time.
- Late payments incur the $5 flat late fee described above and reset your on-time streak.
- Default and extended non-payment may be reported to the counter-party, result in collection activity permitted by law, and reduce your in-app credit score.
- Early repayment is permitted at any time with no additional fee.
6. Lending
- Funds you commit to a loan are moved from your in-app balance to the borrower when you accept their request. Peer4Peer does not guarantee repayment.
- Interest income you earn through Peer4Peer may be reportable to the IRS. Peer4Peer will issue a 1099-INT in January for the prior tax year to any lender whose aggregate reportable interest meets the applicable reporting threshold.
- Because Peer4Peer caps interest at your borrower's state APR limit (never more than 35% simple APR), lender returns are intentionally modest. Lending through Peer4Peer is intended for community support, not high-yield investing.
7. Fees and Taxes
- Platform service fees, Plus subscriptions, and late fees are not refundable.
- You are solely responsible for determining what, if any, taxes apply to your transactions on Peer4Peer and for reporting and remitting those taxes.
8. Prohibited Conduct
You agree not to:
- Create an account with false or someone else's information.
- Use another user's account.
- Attempt to defraud the Service, bypass security, or scrape data.
- Harass, threaten, intimidate, or discriminate against other users or Peer4Peer staff.
- Post, send, upload or display any content that is unlawful, hateful, obscene, sexually explicit, violent, misleading, infringing, or that promotes self-harm.
- Impersonate another person, create multiple accounts, or interfere with another user's ability to use the Service.
- Use the Service for any illegal purpose, including money laundering or terrorist financing.
- Charge or attempt to charge more than the Service's statutorily-capped interest and fees.
Violations may result in content removal, account suspension, permanent ban, and reporting to the appropriate authorities.
8a. User Content, Reporting, and Blocking (User-Generated Content Policy)
Peer4Peer is a marketplace where users see each other's names, loan requests, and ratings. We have a zero-tolerance policy for abusive content and users, in line with Google Play's User-Generated Content requirements. Specifically:
- In-app reporting: every borrower profile and loan request includes a "Report" option. Reports are reviewed by Peer4Peer's compliance team within one business day.
- Blocking: filing a report automatically hides the reported user from your marketplace and your activity. You can also block any user manually from their profile.
- Enforcement: users found to have posted abusive, hateful, fraudulent, or sexually explicit content are permanently removed from the Service. Repeat or egregious offenders are reported to law enforcement and to Google Play.
- Appeals: suspended users may appeal to support@peer4peerloans.com within 30 days of suspension. Decisions by Peer4Peer Lending, LLC are final.
We do not permit any of the following content categories anywhere on the Service:
- Hate speech, slurs, or content that targets a protected class.
- Sexual content, nudity, or sexually suggestive solicitations.
- Violent threats, graphic violence, or glorification of self-harm.
- Content that depicts minors in a sexualised or exploitative way.
- Promotion of illegal activity, controlled substances, or weapons sales.
If you encounter any content that violates these rules, use the in-app Report flow or email support@peer4peerloans.com with a screenshot and the user's name.
9. Intellectual Property
Peer4Peer, the Peer4Peer wordmark, and all app content, source code, and designs are owned by Peer4Peer Lending, LLC. You receive a limited, non-exclusive, revocable license to use the Service for your personal, non-commercial purposes.
10. Disclaimers
The Service is provided "as is" and "as available". We disclaim all warranties to the maximum extent permitted by law. We make no warranty that the Service will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, Peer4Peer Lending, LLC's total liability to you for any claims arising from or related to the Service is limited to the greater of (a) the total fees you paid to Peer4Peer in the twelve months before the claim arose, or (b) one hundred U.S. dollars. We are not liable for indirect, incidental, special, consequential, or punitive damages.
12. Dispute Resolution and Governing Law
- These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflicts of law.
- Any disputes shall first be subject to good-faith informal resolution for 30 days.
- Where not prohibited by law, disputes that cannot be resolved informally shall be resolved by binding arbitration on an individual basis; you waive the right to participate in a class action.
13. Changes
We may revise these Terms. If we make material changes we will notify you and update the "Effective date". Continued use of the Service after the new effective date constitutes acceptance.
